Who can be held responsible for my attack?

Multiple parties may be legally responsible for a sexual assault, especially when negligence or institutional failures are involved. Just as property owners can be held accountable in slip and fall cases cases and negligent drivers are liable in auto accident injury claims, organizations that ignore warnings or fail to protect individuals may also face legal responsibility. Schools, employers, or organizations that disregard complaints, turn a blind eye to inappropriate behavior, have insufficient screening policies and procedures, or fail to take reasonable steps to prevent customers or guests from sexual abuse may be liable.

Common types of businesses and institutions that may be held liable for sexual assault include:

  • Employers
  • Daycare and childcare centers
  • Public Schools
  • Universities
  • Summer Camps
  • Hotels
  • Apartment complexes
  • Churches and other religious institutions

Is there a time limit on how long I can pursue a lawsuit?

A statute of limitations is a law that sets the maximum period for filing a lawsuit. The time frame can vary depending on the type of case or claim.  In Washington, the statute of limitations may be extended under certain circumstances for minor victims of sexual abuse.
